Second Chance OS™ (the "Service") is operated by Platium AICA LLC("we", "us", "our"). By accessing or continuing to use the Service, you agree to be bound by these Terms & Conditions. If you do not agree, do not use the Service.
Second Chance OS™ provides education, document organization, document review support, and referral pathways to help users understand and prepare materials related to background reports, court records, driving records, employment screening, and similar personal records. We are not a law firm, consumer reporting agency, background check company, or employment agency. We do not guarantee employment, expungement, report correction, or any legal outcome.
You agree not to misuse the Service. You will not:
You are responsible for keeping your account credentials confidential and for activity under your account.
All software, content, branding, and documentation that make up the Service are owned by Platium AICA LLC or its licensors. We grant you a limited, non-exclusive, non-transferable right to use the Service within your selected plan. You may not reverse engineer, resell, redistribute, or circumvent the technical limits of the Service.
You retain ownership of the documents and information you upload. You grant Platium AICA LLC a limited license to host, process, and display that content solely to provide the Service to you.
The Service is provided on an "as is" and "as available" basis. We do not guarantee that the Service will be uninterrupted, error-free, or that any specific result will be achieved. To the fullest extent permitted by law we disclaim all implied warranties including merchantability and fitness for a particular purpose.
Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. Payment terms, billing frequency, tax collection, currency conversion, and cancellation mechanics are governed by Paddle's Buyer Terms at paddle.com/legal/checkout-buyer-terms. Our refund policy is available at /refunds.
We may suspend or terminate your access to the Service for: material breach of these Terms, non-payment, security or fraud risk, or repeated or serious policy violations. On termination, your right to use the Service ends; we will provide a reasonable window to export your data where feasible.
To the maximum extent permitted by law, our aggregate liability for any claim arising out of or relating to the Service is limited to the fees you paid to us in the twelve (12) months preceding the event giving rise to the claim. We are not liable for indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill. Nothing in these Terms excludes liability for fraud, death, or personal injury caused by negligence where such exclusion is not permitted by law.
You agree to indemnify and hold Platium AICA LLC harmless from claims arising out of your user content, your unlawful use of the Service, or your violation of these Terms.
These Terms are governed by the laws of the United States and the state in which Platium AICA LLC is organized, without regard to conflict-of-laws principles. The courts located in that jurisdiction will have exclusive jurisdiction over any dispute.
We may update these Terms from time to time. We will post the updated version on this page and revise the "Last updated" date. Continued use of the Service after changes take effect constitutes acceptance.
